Subject to Seller obtaining Grant of Probate and Registration of Transmission Application to Personal Representative

1.1 The parties acknowledge and agree that:-

a. The Contract has been signed by the Seller in their capacity as Personal Representative of the Estate of the late [FULL NAME OF DECEASED] (deceased); and

b. The Property is still registered in the name of the deceased and has not yet been transferred to the Seller in their capacity as Personal Representative.

1.2 This Contract is subject to and conditional on:-

a. The Seller giving written notice to the Buyer within 60 days of the Contract Date that the Seller has obtained a Grant of Probate from the Supreme Court of Queensland; and

b. The Seller giving written notice to the Buyer within 21 days of satisfaction of Special Condition 1.2(a) that they have caused a Transmission Application to Personal Representative to be registered with Titles Queensland Pty Ltd naming the Seller, in their capacity as Personal Representative, as the registered owner of the Property.

1.3 The Settlement Date shall be 14 days from the date on which the Seller gives the Buyer notice in accordance with Special Condition 1.2(b).

1.4 In the event that the Seller has not satisfied Special Condition 1.2(a) or 1.2(b) by the respective due dates then either party may terminate this Contract whereupon the Deposit will be refunded in full to the Buyer and neither party will have any further claim against the other.
