1.1 This Contract is subject to and conditional upon the Seller, at its own expense, ensuring that all rubbish and debris are removed from the Property and that the improvements on the Property are in a neat, clean and tidy condition no later than 5:00pm the Business Day prior to Settlement. If the Seller does not have these works completed no later than 5:00pm the Business Day prior to Settlement, the Buyer may at the Buyer’s election either:
a. Deduct the sum of $[INSERT SUM] from the balance of purchase price at Settlement; or
b. Terminate the Contract and the Deposit shall be refunded in full to the Buyer.
