1. The parties acknowledge and agree that:-
a. The Contract has been signed by the Seller in their capacity as Personal Representative of the Estate of the late [FULL NAME OF DECEASED] (deceased); and
b. The Property is still registered in the name of the deceased and has not yet been transferred to the Seller in their capacity as Personal Representative.
2. This Contract is subject to and conditional on the Seller causing a Transmission Application to Personal Representative to be registered with Titles Queensland Pty Ltd on or before 60 days from the Contract Date.
3. The Settlement Date shall be 14 days from the date on which the Seller gives the Buyer notice that registration of the Transmission Application has been effected.
4. In the event that the Seller has not caused a Transmission Application to Personal Representative to be registered with Titles Queensland Pty Ltd on or before 60 days from the Contract Date then either party may terminate this Contract whereupon the Deposit will be refunded in full to the Buyer and neither party will have any further claim against the other.
